Resolution......I hope
I had written on another thread (that I can't find now) regarding a website that still hadn't been paid for. Well, here is some of the recent correspondence I personally wrote to the client and responses back from the client. I thought I'd let you see what has transpired.
Please keep in mind that this client is being very harsh in all of their emails to me including saying to "write my dealings off as bad business."

When we requested the files you did not understand and you still don't.
The FLA file is a Flash Movie file that will and does play as a movie,
but there is no way to correct or modify it. It is like an executable.
The source file for the flash is a SWF file that CAN be modified and

(This is what I wrote back—below.....and please do not use this tone with a client unless you know for a fact they can't harm your company and you are in the right. I was pretty mad when I read this email since the client is not knowledgeable in Flash and has not listened to reason.)

Are you that stupid? Here are the definitions for a Flash file (native and published):
swf File extension for a published Flash movie. This is what plays on the internet.
fla File extension for a NATIVE Flash file. (This is the NATIVE file that I gave you on CD and this is also what you received confirmed by your email below.)
It's not our fault if you don't know which file is which and you really should do research on things you don't know about before barking up the wrong tree. Any person who works in Flash can tell you it's obvious you got a finished product from us because we delivered the .fla file.
If we don't receive the final payment of $1000.00 by Friday of this week (August 24, 2007), we are definitely going to take legal action (be careful what you wish for). I have lots of time to pursue this small amount of money matter (I don't easily overlook things) and I don't like being hassled by someone so crooked. The point of the matter is that you and Bill owe us the money and you know it.
And don't worry about taking the website down. All of the pages have been documented to prove that you've been using all of the complete files for about a year now.

I don’t really appreciate your slanderous remarks. You really don’t know me. I talked with Bill and he is sending me a check today. When I get it I will send you the $1000. Quite frankly it is not worth the effort. The web site may be up, but it is NOT finished and not working to the point Bill can make a single dime from. But we want to be done with you. So you will get a check. This will be the last communication from me other than a check by mail.

So this is how I handled this difficult client. I'm hoping the check arrives promptly so I don't have to send him to collections.
The moral of the story is, if you did what was expected and it's in writing (which all of mine is) it's your money—fight for it.
