I have given the company 5 days before I take it further under "passing off" Dontaskme thanks for your reply.

No this is not my site I run a small firm with a team of 6 and trevor saint did some overflow design work for us.

"So infact you're a designer that draws inspiration from all the CSS sites, yet has another web design firm to create your portfolio, and some of the work in it(Be Healthy)?"

I am not a designer, well not a very good one anyway! I run the company I have many designers, developers who do work for me

Hope this clears things up for you..


Bottom line is fabspider have ripped my site off and yes your right normally I would be proud if the company did a good job but it looks like it took 10 minutes to build just after he screen printed my site started removing anything that may to do with Cow & Monkey..

Then did a very poor attempt in Flash and i have not checked but doubt it validates..

Anyway I think topic has been overcooked now but thanks all for feedback.

My main goal was to talk about it in a forum to make sure the domain is then indexed by Google and get in the top 5 listings which should be done by now.

Hmm, I really don't see this site as a 'rip'. I'm no designer, but I see a 'rip' as a complete clone of a site. Looking at the sites, the only thing that they have in common is the banner image and general layout. As for a screen print, that is absolute rubbish, the images are infact different images, the colours are different(checked with color cop). In my opinion it is actually and inspired design, yes it looks similar, but if you look at all the CSS showcases on the net most of the sites within them are very much alike, does this make them 'rips'? I very much doubt it. Look at your friends site, Clean. Vibrant. Accessible. Website design and development of standards complient web technologies - trevorsaint.com, nice site, which I presume is an original site? but don't you think it has a similar style to CSSArtillery.com ? Does this make it a 'rip'? I doubt it.

Looking through the code, they have actually done a good job with, the code actually looks tidier than yours. As for validating, just checked, it does...

'Overflow work' I wouldn't consider having a design company design the portfolio of another design company 'overflow work'.

Anyway, that's just my thoughts, as for the 'passing off' case, that's your choice, but as I see it from a third parties view, the way you have gone about things could leave you open to a slander case from the other party.
I'm no lawyer, but that's the way it looks...

Default good point but i disagre

Mate open two browser windows and quickly flick between the two, for one the background pretty much stays the same and does not move a single pixel.

Of course colours changes a little as they might think they copied my site to much....

Why would you not call it "overflow" work we dont get paid to do our site and as Trevor was local and good mate thought it would be nice to throw some work his way keeping us on the "bread N butter" work.

As I have mentioned before I dont mind example of "similer" work but 8/10 people agree this is a rip.

As for possible slander if anyone could be seen to be causing "defamation" its fabspider.

"making a false claim, expressively stated or implied to be factual, that may harm the reputation of an individual, business"

I feel we should close this thread as its done what I wanted in geeting feedback and seeing what the 3rd party views are.
